TERMS OF SALE, REFUND POLICY, AND BINDING TRANSACTION AGREEMENT
Effective Date: November 1st 2025
LEGAL NOTICE — READ BEFORE PURCHASING
THIS DOCUMENT CONSTITUTES A LEGALLY BINDING AGREEMENT BETWEEN THE PURCHASER ("CUSTOMER," "YOU," "BUYER") AND PAWPERIMETER, LLC ("COMPANY," "SELLER," "WE," "US"). BY COMPLETING A PURCHASE ON THIS WEBSITE, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY ALL TERMS, CONDITIONS, AND POLICIES SET FORTH HEREIN. COMPLETION OF CHECKOUT CONSTITUTES IRREVOCABLE ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, DO NOT COMPLETE YOUR PURCHASE.
ARTICLE I — 30-DAY DOG CONTAINMENT GUARANTEE
1.1 Nature of Guarantee. PawPerimeter offers a 30-DAY DOG CONTAINMENT GUARANTEE on all GPS wireless dog fence collar purchases. THIS IS NOT A MONEY-BACK GUARANTEE. This is NOT a satisfaction guarantee, NOT a trial period, NOT a "try it and return it" policy, and NOT an unconditional refund offer. This guarantee is a structured, performance-based program that requires Customer's active and documented participation in a mandatory training protocol before any claim will be considered.
1.2 Not a Money-Back Guarantee. Customer expressly acknowledges and agrees that this guarantee does NOT entitle Customer to a refund simply because they are unsatisfied, changed their mind, or decided the product is not for them. A refund under this Article is available ONLY after Customer has fully completed the mandatory training protocol described below and has demonstrated, through comprehensive video documentation, that the product fails to contain the dog despite proper and consistent use.
1.3 Mandatory Training Protocol. To be eligible for any claim under this guarantee, Customer MUST complete ALL of the following:
(a) Customer must train their dog using the PawPerimeter GPS wireless dog fence collar for a MINIMUM of fifteen (15) minutes per day, every day, for thirty (30) consecutive days beginning from the date of confirmed delivery
(b) Customer must follow PawPerimeter's Official Training Guide exactly as provided, including boundary setup, correction level progression, and behavioral conditioning steps
(c) The collar must be properly fitted on the dog per included instructions throughout the entire 30-day training period
(d) Training must be conducted in good faith with genuine effort to achieve containment
(e) Customer must not skip any days during the 30-day training period; any gap in training resets the eligibility clock or voids the claim at PawPerimeter's sole discretion
1.4 Mandatory Video Documentation. Customer MUST provide complete and continuous video documentation of the entire 30-day training process. Specifically:
(a) Customer must record video of each daily training session for all thirty (30) days
(b) Each video must clearly show the dog wearing the properly fitted collar, the training area, boundary setup, and the training activities being performed
(c) Videos must be dated and demonstrate that training was conducted on consecutive days
(d) Customer must submit all thirty (30) days of video documentation to PawPerimeter upon filing a claim
(e) Incomplete, edited, manipulated, undated, or non-consecutive video submissions will result in automatic denial of the claim
(f) PawPerimeter reserves the right to request additional video angles, documentation, or evidence at its sole discretion
1.5 Claim Submission. Claims under this guarantee must be submitted within five (5) days of completing the full 30-day training protocol. Claims must include:
(a) All thirty (30) days of video documentation as described in Section 1.4
(b) A written description of the specific containment failure experienced
(c) Evidence of boundary setup configuration
(d) Any additional documentation PawPerimeter reasonably requests
1.6 Product Return Requirement. If PawPerimeter determines that a claim is valid:
(a) Customer MUST return the complete collar system, including all accessories, in its original packaging
(b) Return shipping costs are the sole responsibility of the Customer
(c) The product must be received by PawPerimeter in the same condition as when shipped, minus normal wear from the 30-day training period
(d) Refund will NOT be processed until the product is received and inspected by PawPerimeter
(e) Products that are damaged beyond normal training wear, missing components, or not returned in original packaging may result in a reduced refund or denial at PawPerimeter's sole discretion
1.7 Refund Processing. If PawPerimeter, in its sole and absolute discretion, determines that the claim is valid AND the returned product passes inspection:
(a) A refund will be issued to the original payment method
(b) Refund amount will be the purchase price paid, minus any applicable shipping costs, restocking fees, or deductions for missing or damaged components
(c) Refunds are typically processed within fourteen (14) business days of product receipt and inspection
1.8 Exclusions. This guarantee does NOT apply to:
(a) Any item purchased during a sale, promotion, discount event, or with any coupon or discount code applied — promotional purchases are governed exclusively by Article IV
(b) Buyer's remorse, change of mind, or dissatisfaction unrelated to containment performance
(c) Failure to complete the full 30-day training protocol as described in Section 1.3
(d) Failure to provide complete video documentation as described in Section 1.4
(e) Products not used for their intended purpose
(f) Damage caused by misuse, neglect, abuse, or improper handling
(g) Cosmetic issues or normal wear and tear
(h) Claims submitted after the 5-day post-training submission window
(i) Extended warranty products, accessories, or add-on purchases
1.9 Claim Denial and Fraud Prevention. PawPerimeter reserves the right to deny any claim that fails to meet all requirements set forth in this Article. Fabricated video evidence, false claims of training compliance, staged demonstrations, or any misrepresentation shall result in automatic denial, permanent ban from future purchases, and may be reported as fraud to payment processors and law enforcement where applicable.
ARTICLE II — DEFINITIONS
2.1 "Transaction" means the purchase of any product or service from PawPerimeter.
2.2 "Delivery Confirmation" means tracking data showing the package was delivered to the address provided by Customer, including but not limited to carrier scans, GPS confirmation, photographic proof of delivery, or signed delivery receipt.
2.3 "Policy Acceptance Event" means the timestamp, IP address, and affirmative checkbox acknowledgment recorded at the time of checkout confirming Customer's agreement to these terms.
2.4 "Final Sale" means a transaction that is non-refundable, non-returnable, non-exchangeable, and not subject to reversal under any circumstances.
2.5 "Chargeback" means any dispute, reversal, or claim initiated by Customer through a bank, credit card issuer, PayPal, or any payment processor seeking to reverse or recover funds from a completed transaction.
ARTICLE III — ALL SALES ARE FINAL
3.1 No General Right of Return. PawPerimeter does not offer refunds, returns, exchanges, or cancellations for any reason, including but not limited to: buyer's remorse, change of mind, dissatisfaction, failure to use the product, failure to read product descriptions or policies, or any other reason not explicitly enumerated in Article I or Article V of this Agreement.
3.2 No Satisfaction Guarantee. PawPerimeter does not provide a "satisfaction guarantee," "no questions asked" return policy, or any similar accommodation. Any marketing language referencing guarantees is subject exclusively to the terms and conditions set forth in Article I and Article V and shall not be construed as offering unconditional refund rights.
3.3 Acknowledgment of Terms. Customer acknowledges that by completing checkout, they have been provided clear and conspicuous notice that all sales are final, and that they are waiving any expectation of refund except as explicitly provided herein.
ARTICLE IV — PROMOTIONAL AND DISCOUNTED PURCHASES — ABSOLUTE FINAL SALE
4.1 Final Sale Designation. ALL products purchased during any sale, promotion, flash sale, clearance event, limited-time offer, discount code application, bundle deal, or markdown of any kind are designated as ABSOLUTE FINAL SALE.
4.2 No Exceptions. For Final Sale items, the following apply without exception:
(a) No refunds shall be issued under any circumstances
(b) No returns shall be accepted for any reason
(c) No exchanges shall be permitted
(d) No store credit shall be issued
(e) No chargebacks shall be honored; all chargebacks will be disputed
(f) No warranty claims shall be accepted
(g) No performance guarantee claims shall be accepted, including under Article I
4.3 Binding Acknowledgment. By completing a purchase during any promotional period, Customer irrevocably agrees that the transaction is final and non-reversible. Customer waives any right to dispute, reverse, or seek recovery of funds through any means, including but not limited to chargebacks, payment processor disputes, or legal action.
ARTICLE V — LIMITED 60-DAY PERFORMANCE-BASED GUARANTEE (NON-PROMOTIONAL PURCHASES ONLY)
5.1 Nature of Guarantee. PawPerimeter offers a LIMITED 60-DAY PERFORMANCE-BASED GUARANTEE exclusively for full-price, non-promotional purchases. This guarantee is NOT a satisfaction guarantee, NOT a trial period, and NOT a "try it and return it" policy. This guarantee is separate from and in addition to the 30-Day Dog Containment Guarantee set forth in Article I.
5.2 Exclusions. This guarantee does NOT apply to:
(a) Any item purchased during a sale, promotion, or discount event
(b) Buyer's remorse or change of mind
(c) Failure to use the product
(d) Failure to complete the required training protocol
(e) Products left unopened, unused, or partially used
(f) Incomplete, abandoned, or improperly executed training
(g) Dissatisfaction unrelated to product functionality
(h) Cosmetic issues or normal wear and tear
(i) Damage caused by misuse, neglect, or improper handling
5.3 Mandatory Eligibility Requirements. To be eligible for consideration under this guarantee, Customer must satisfy ALL of the following conditions:
(a) Product must be received and actively used for its intended purpose
(b) Collar must be properly fitted on the dog per included instructions
(c) Customer must complete a MINIMUM of seven (7) consecutive days of documented training
(d) Customer must follow PawPerimeter's Official Training Guide exactly, including boundary setup, correction level progression, and behavioral conditioning steps
(e) Customer must demonstrate documented good-faith effort throughout the training period
(f) Claim must be submitted within sixty (60) days of confirmed delivery date
5.4 Required Documentation. Customer must provide, upon request:
(a) Photographic or video evidence of proper collar fitting
(b) Training log documenting dates, times, and activities
(c) Evidence of boundary setup configuration
(d) Description of specific product malfunction or failure
(e) Any additional documentation PawPerimeter reasonably requests
5.5 Valid Claims. This guarantee applies ONLY if:
(a) All eligibility requirements in Section 5.3 are satisfied
(b) All documentation requirements in Section 5.4 are fulfilled
(c) The product demonstrably fails to perform its intended function despite documented proper use
5.6 Resolution. If PawPerimeter, in its sole and absolute discretion, determines that a claim is valid:
(a) PawPerimeter may issue a refund, OR
(b) PawPerimeter may provide a replacement product, OR
(c) PawPerimeter may offer an alternative resolution
Refunds are NOT guaranteed, are NOT automatic, and are NOT the default resolution. The form of resolution shall be determined exclusively by PawPerimeter.
5.7 Return Requirements. Product return may be required. Return shipping costs are Customer's sole responsibility. Products must be returned in original packaging with all included accessories.
5.8 Claim Denial. PawPerimeter reserves the right to deny any claim that fails to meet all requirements. Abuse of this guarantee, false claims of compliance, or misrepresentation of training completion shall result in automatic denial and may be reported as fraud.
ARTICLE VI — SHIPPING, DELIVERY, AND RISK OF LOSS
6.1 Processing Time. Orders are typically processed within two to three (2–3) business days of payment confirmation.
6.2 Estimated Delivery. Estimated delivery time is seven to fourteen (7–14) business days after processing. However, due to factors outside PawPerimeter's control, including but not limited to carrier delays, weather events, customs inspections, peak shipping seasons, routing errors, and logistical disruptions, delivery may take up to forty-five (45) days.
6.3 Estimates Not Guarantees. All delivery timeframes are ESTIMATES ONLY and do not constitute guarantees. Shipping delays are NOT grounds for refunds, returns, cancellations, or chargebacks under any circumstances.
6.4 Transfer of Risk. Risk of loss and title transfer to Customer upon tender of the package to the shipping carrier. PawPerimeter's responsibility ends when the package is in the carrier's possession.
6.5 Delivery Confirmation. A package shall be deemed delivered when tracking data shows delivery to the address provided by Customer. PawPerimeter is not responsible for:
(a) Packages marked as delivered by the carrier
(b) Theft or loss after delivery confirmation
(c) Delivery to incorrect addresses provided by Customer
(d) Failed deliveries due to address errors, access issues, or recipient unavailability
6.6 Lost Package Claims. If Customer claims non-receipt:
(a) Customer must allow the full forty-five (45) day delivery window to expire
(b) PawPerimeter will conduct an investigation using tracking data, carrier confirmations, and address verification
(c) Replacements MAY be issued at PawPerimeter's sole discretion if investigation supports the claim
(d) Refunds are NOT guaranteed for delivery issues
(e) False claims of non-delivery constitute fraud and will be disputed with all available evidence
ARTICLE VII — CUSTOMER RESPONSIBILITIES AND WARRANTIES
7.1 Accurate Information. Customer warrants that all information provided at checkout is accurate, complete, and current, including shipping address, billing address, contact information, and email address.
7.2 Policy Review. Customer warrants that they have read and understood all product descriptions, specifications, and policies before completing their purchase.
7.3 Proper Use. Customer is solely responsible for proper use, setup, and maintenance of the product in accordance with provided instructions.
7.4 Sufficient Delivery Time. Customer agrees to allow sufficient time for delivery (up to 45 days) before initiating any claim of non-receipt.
7.5 Good Faith. Customer warrants that all claims, communications, and representations made to PawPerimeter are truthful, accurate, and made in good faith.
ARTICLE VIII — CHARGEBACK AND DISPUTE PROHIBITION
8.1 Covenant Not to Dispute. By completing a purchase, Customer expressly covenants and agrees NOT to initiate any chargeback, payment dispute, claim, or reversal request with any bank, credit card issuer, PayPal, or payment processor for any of the following reasons:
(a) Shipping delays within the disclosed forty-five (45) day delivery window
(b) Buyer's remorse, change of mind, or dissatisfaction
(c) Failure to read or understand product descriptions, specifications, or policies
(d) Failure to complete required training protocol
(e) Disputes regarding product effectiveness without completing training requirements under Article I or Article V
(f) Delays caused by third-party shipping carriers
(g) Any purchase made during a sale, promotion, or discount event
(h) Packages showing delivered status in carrier tracking
(i) Any matter that does not qualify for refund under Article I or Article V
8.2 Chargeback Constitutes Breach. Initiation of a chargeback in violation of this Agreement constitutes a material breach of contract and fraud.
8.3 Dispute Response. PawPerimeter will dispute ALL chargebacks with comprehensive documentation, including but not limited to:
(a) Complete order records and transaction history
(b) Tracking information and delivery confirmation
(c) Policy Acceptance Event logs (timestamp, IP address, checkbox confirmation)
(d) Complete customer communication records
(e) Product descriptions and specifications as displayed at time of purchase
(f) This Agreement as accepted by Customer
(g) Any additional evidence supporting the validity of the transaction
8.4 Consequences of Unauthorized Chargebacks. Customers who initiate unauthorized chargebacks may be subject to:
(a) Permanent ban from all future purchases
(b) Reporting to payment processor fraud prevention systems
(c) Collection efforts for recovered funds plus associated fees
(d) Legal action to recover damages, costs, and attorney's fees where permitted by law
8.5 Fraud Reporting. False claims of non-delivery, false claims of product defect, and chargebacks initiated in bad faith may be reported to fraud prevention databases and law enforcement where applicable.
ARTICLE IX — EVIDENCE OF CONTRACT FORMATION
9.1 Policy Acceptance Logging. PawPerimeter maintains comprehensive records of each Customer's agreement to these terms, including:
(a) Date and timestamp of policy acceptance (UTC)
(b) IP address at time of checkout
(c) Affirmative checkbox confirmation of policy agreement
(d) Browser and device information
(e) Order confirmation email sent to Customer containing links to all policies
9.2 Admissibility. Customer agrees that electronic records of policy acceptance are admissible as evidence of contract formation and are equivalent to a signed written agreement.
9.3 Integration. This Agreement, including all policies incorporated by reference and displayed at checkout, constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to this subject matter.
ARTICLE X — LIMITATION OF LIABILITY
10.1 Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAWPERIMETER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER PAWPERIMETER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.2 Maximum Liability. PAWPERIMETER'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO ANY TRANSACTION SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY CUSTOMER FOR THE SPECIFIC PRODUCT AT ISSUE.
10.3 Third-Party Actions. PawPerimeter is not liable for any delays, losses, damages, or failures caused by third-party shipping carriers, payment processors, or other service providers.
ARTICLE XI — EXTENDED WARRANTY
11.1 Extended warranties are optional post-purchase add-ons covering one (1) system only.
11.2 Warranty coverage is non-transferable and applies exclusively to the specific system for which it was purchased.
11.3 Extended warranty purchases are Final Sale and non-refundable.
11.4 Warranty does not cover: normal wear and tear, damage from misuse or neglect, loss or theft, unauthorized modifications, or damage from third-party accessories.
ARTICLE XII — GENERAL PROVISIONS
12.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
12.2 Dispute Resolution. Any dispute arising out of or relating to this Agreement or any transaction shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Customer waives any right to participate in a class action lawsuit or class-wide arbitration.
12.3 Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12.4 Modification. PawPerimeter reserves the right to modify this Agreement at any time. The version posted on the website at the time of purchase governs that transaction.
12.5 Right to Refuse Service. PawPerimeter reserves the right to refuse service, cancel orders, and deny future purchases to any Customer who violates these terms or initiates bad-faith disputes.
12.6 Waiver. Failure by PawPerimeter to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
12.7 Assignment. Customer may not assign any rights or obligations under this Agreement without PawPerimeter's prior written consent.

BY COMPLETING YOUR PURCHASE, YOU ACKNOWLEDGE THAT:
(1) YOU HAVE READ THIS AGREEMENT IN ITS ENTIRETY
(2) YOU UNDERSTAND AND AGREE TO ALL TERMS AND CONDITIONS
(3) YOU UNDERSTAND THAT THE 30-DAY DOG CONTAINMENT GUARANTEE IS NOT A MONEY-BACK GUARANTEE AND REQUIRES COMPLETION OF THE FULL TRAINING PROTOCOL WITH VIDEO DOCUMENTATION
(4) YOU UNDERSTAND THAT ALL SALES ARE FINAL EXCEPT AS EXPLICITLY PROVIDED IN ARTICLE I AND ARTICLE V
(5) YOU UNDERSTAND THAT PROMOTIONAL PURCHASES ARE NON-REFUNDABLE UNDER ANY CIRCUMSTANCES
(6) YOU WAIVE ANY EXPECTATION OF REFUND NOT EXPLICITLY PROVIDED HEREIN
(7) YOU AGREE NOT TO INITIATE CHARGEBACKS FOR REASONS PROHIBITED BY THIS AGREEMENT
(8) THIS AGREEMENT IS LEGALLY BINDING AND ENFORCEABLE
